“Former President Donald Trump is urging the US Supreme Court to reverse the Colorado Supreme Court’s ruling that removed him from that state’s ballot.
The brief submitted by Trump’s attorneys Thursday to the high court sets out their arguments for why the state court erred when it issued the unprecedented decision last month.
“The Court should reverse the Colorado decision because President Trump is not even subject to section 3, as the President is not an ‘officer of the United States’ under the Constitution. And even if President Trump were subject to section 3 he did not ‘engage in’ anything that qualifies as ‘insurrection,’” Trump’s attorneys argued.
The efforts, Trump team argues, “promise to unleash chaos and bedlam if other state courts and state officials follow Colorado’s lead and exclude the likely Republican presidential nominee from their ballots.”
The Colorado Supreme Court last month said Trump is constitutionally ineligible to run in 2024 because the 14th Amendment’s ban on insurrectionists holding office covers his conduct on January 6, 2021.
The US Supreme Court agreed earlier this month to hear the case, accepting an appeal brought by Trump. The justices are separately involved in other matters that could impact the federal criminal case against the former president.

The Brookings Cafeteria podcast last week discussed the role President Trump’s racist rhetoric has played in encouraging violence in America.
First, Donald Trump’s support in the 2016 campaign was clearly driven by racism, sexism, and xenophobia. While some observers have explained Trump’s success as a result of economic anxiety, the data demonstrate that
anti-immigrant sentiment, racism, and sexism are much more strongly related to support for Trump.Even more alarmingly, there is a clear correlation between Trump campaign events and incidents of prejudiced violence. FBI data show that since Trump’s election there has been
an anomalous spike in hate crimes concentrated in counties where Trump won by larger margins. It was the second-largest uptick in hate crimes in the 25 years for which data are available, second only to the spike after September 11, 2001.Though hate crimes are typically most frequent in the summer, in 2016 they peaked in the fourth quarter (October-December). This new, higher rate of hate crimes continued throughout 2017.

The association between Trump and hate crimes is not limited to the election itself. Another study, based on data collected by the Anti-Defamation League, shows that counties that hosted a Trump campaign rally in 2016 saw hate crime rates more than double compared to similar counties that did not host a rally.

On his Gab.com account, Bowers claimed Jews were helping transport members of the migrant caravans. He shared a video that another Gab.com user posted, purportedly of a Jewish refugee advocacy group HIAS on the US-Mexico border. Another post that Bowers commented on described HIAS’ overall efforts as “sugar-coated evil.”

According to his posts, Bowers believed that those in the migrant caravans were violent because they were attempting to leave countries that had high levels of violence. And Bowers repeatedly called them “invaders” on his Gab posts. “I have noticed a change in people saying ‘illegals’ that now say ‘invaders’,” read one post, six days before the shooting. “I like this.”

In a sentencing memo filed last month, Sayoc’s attorneys said the 57-year-old former pizza deliverer became radicalized via a daily consumption of Trump’s tweets, Fox News, and conspiracy theories on the internet.
They said Sayoc sent the packages because he believed that “prominent Democrats were actively working to hurt him, other Trump supporters, and the country as a whole” — an idea that was reinforced by what he heard on Fox News and from the president himself.
When Trump announced he was running for president, Sayoc “enthusiastically supported him” and began watching Fox News religiously and planning his day around watching Fox & Friends in the morning and primetime host Sean Hannity in the evening, his attorneys said.
“We believe that the president’s rhetoric contributed to Mr. Sayoc’s actions in this offense,” Sayoc’s attorney Ian Howard Marcus Amelkin told the court Monday.
