Wisconsin judge allows civil case against fake Trump electors to proceed
A Wisconsin judge on Thursday allowed a civil lawsuit filed against 10 fake electors for former President Donald Trump and two of his attorneys to proceed, rejecting a move to dismiss the case.
The lawsuit is moving ahead in Wisconsin after Michigan’s attorney general filed felony charges on July 18 against 16 Republicans who acted as fake electors for Trump, accusing them of submitting false certificates that confirmed they were legitimate electors despite Joe Biden’s victory in the state.
The fake elector plan was central to the federal indictment filed against Trump earlier this month that alleged he tried to overturn results of the 2020 election. Federal prosecutors said the scheme originated in Wisconsin.”

Are there restrictions on who the electors can vote for?
“There is no Constitutional provision or Federal law that requires electors to vote according to the results of the popular vote in their States. Some States, however, require electors to cast their votes according to the popular vote. These pledges fall into two categories—electors bound by State law and those bound by pledges to political parties.
The U.S. Supreme Court has held that the Constitution does not require that electors be completely free to act as they choose and therefore, political parties may extract pledges from electors to vote for the parties’ nominees. Some State laws provide that so-called “faithless electors” may be subject to fines or may be disqualified for casting an invalid vote and be replaced by a substitute elector. The Supreme Court decided (in 2020) that States can enact requirements on how electors vote. No elector has ever been prosecuted for failing to vote as pledged. However, several electors were disqualified and replaced, and others fined, in 2016 for failing to vote as pledged.”

“We are accustomed to choosing electors by popular vote, but nothing in the Constitution says it has to be that way. Article II provides that each state shall appoint electors “in such Manner as the Legislature thereof may direct.” Since the late 19th century, every state has ceded the decision to its voters. Even so, the Supreme Court affirmed in Bush v. Gore that a state “can take back the power to appoint electors.” How and when a state might do so has not been tested for well over a century.
Trump may test this. According to sources in the Republican Party at the state and national levels, the Trump campaign is discussing contingency plans to bypass election results and appoint loyal electors in battleground states where Republicans hold the legislative majority. With a justification based on claims of rampant fraud, Trump would ask state legislators to set aside the popular vote and exercise their power to choose a slate of electors directly. The longer Trump succeeds in keeping the vote count in doubt, the more pressure legislators will feel to act before the safe-harbor deadline expires.”
